Terms of Service
The deal between us.
The short version
You sign up, build an EPK, pay if you want to publish. Your content stays yours. We host it and don't claim ownership. Don't use LiveEPK to do illegal things or harass people. Either of us can end the agreement; if we do, we'll give you your data back. Texas law governs.

Who you're agreeing with
LiveEPK is a trade name of a Texas sole proprietorship operated by Jerod Johnson. In these Terms, "we", "us", and "LiveEPK" mean the same thing. "You" means the person using the service.
By creating an account or using LiveEPK in any way, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the service.

The service
LiveEPK is a web tool for building and publishing electronic press kits (EPKs). The service includes:
- An editor for assembling EPK content (free).
- Publishing your EPK at a subdomain (paid).
- An asset library and email composer on the Standard tier.
- Updates, new templates, and bug fixes over time.
We may add, change, or remove features. We'll try not to remove anything you depend on without notice, but we don't guarantee any particular feature stays available forever.

Your account
To use LiveEPK, you need an account. You're responsible for:
- Giving us accurate information when you sign up.
- Keeping your password (or third-party sign-in) secure.
- Everything that happens under your account.
You must be at least 13 to use LiveEPK, and 18 to subscribe to a paid plan. If you're under 18 and creating an EPK, a parent or guardian should set up the paid account on your behalf. We are not a service for children under 13.

Pricing, payment, and subscriptions
Current pricing:
- Free editor: $0. Build the EPK; no published URL.
- Basic: $6 per month. Publishes the EPK at a generated subdomain (e.g. e482103.liveepk.com).
- Standard: $15 per month or $120 per year. Custom subdomain at yourname.liveepk.com, asset library, email composer, and every current and future template.
How billing works
- Payments are processed by Stripe. You authorize Stripe to charge your payment method on a recurring basis at the price for your plan.
- Subscriptions renew automatically until you cancel.
- Annual plans are billed once per year up front.
- We may change pricing for new sign-ups at any time. If we change pricing on an existing plan, we'll notify you in advance.
- You're responsible for any taxes that apply where you live.
Cancellation and refunds
- You can cancel any time from your dashboard. Your access to paid features continues through the end of the current billing period.
- After cancellation, your Standard subdomain is held for 90 days and your Basic subdomain is held for 365 days in case you want to come back. After that, the subdomain is released and may be reassigned.
- Your EPK content stays in the editor after cancellation; only the live URL goes offline.
- We don't offer refunds for partial months or unused time on annual plans, except where required by law. If something has clearly gone wrong on our end, write to us and we'll work it out.
Upgrades and downgrades
You can upgrade from Basic to Standard at any time; we'll prorate the difference through Stripe. Downgrades take effect at the end of your current billing period. If you downgrade from Standard to Basic, your custom subdomain is released and you'll be assigned a generated one.

Your content
You own it
Anything you upload, type, or otherwise put into LiveEPK is and remains yours. We don't claim ownership of your photos, music, video links, bio, press quotes, contacts, or any other content you create.
What you let us do with it
To run the service, you give LiveEPK a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, and display your content as needed to provide the service to you and to people who visit your EPK. This license ends when you delete the content or your account, except for backup copies that may take a short time to purge.
We do not use your content for advertising. We do not train any AI models on your content. We do not sell your content.
You're responsible for what you upload
You represent that you have the right to use everything you upload. If you put someone else's photo, song, video, or press writing on your EPK without permission, that's between you and them. We may have to take it down if we receive a valid takedown notice.
DMCA
If you believe content on a LiveEPK-hosted EPK infringes your copyright, send a notice to [email protected] with the elements required by 17 U.S.C. ยง 512(c)(3): identification of the work, identification of the infringing material with its URL, your contact info, a statement of good-faith belief, a statement under penalty of perjury that you're authorized to act, and your signature.

Acceptable use
You agree not to use LiveEPK to:
- Publish anything illegal where you live or where the EPK is served.
- Infringe someone else's copyright, trademark, right of publicity, or other rights.
- Harass, threaten, defame, or impersonate any person or organization.
- Publish sexually explicit content involving minors, or content that sexualizes minors in any way.
- Distribute malware, run phishing schemes, or use LiveEPK as part of any scam.
- Sell or attempt to sell illegal goods, controlled substances, weapons, or stolen property.
- Reverse-engineer, scrape, or otherwise abuse the service in ways that interfere with how it works for others.
- Use the platform to spam, including using the email composer to send unsolicited bulk email.
If you violate any of the above, we may remove the offending content, suspend your account, or end your subscription without refund. For severe or repeated violations, we'll terminate the account.
Subdomain rules
Custom subdomains (yourname.liveepk.com) are issued on a first-come basis. You agree not to register a subdomain that:
- Impersonates a real person, band, or brand you don't represent.
- Squats on a trademark with intent to sell it.
- Is intentionally offensive, profane, or otherwise inappropriate.
We may take back a subdomain that violates these rules. We'll notify you and give you a chance to pick a different one.

Beta features and templates
We sometimes ship features in beta or preview form. They may change, break, or disappear. Use them knowing that.
Standard tier includes every current template and every future template we release. Basic tier includes only the three templates available at the time you sign up. Future templates added after your sign-up may not be available on Basic. If you want every template going forward, upgrade to Standard.

Termination
You can stop using LiveEPK any time by cancelling and (if you wish) requesting deletion of your account.
We may terminate or suspend your account if:
- You materially breach these Terms.
- Your payment fails repeatedly and isn't fixed within a reasonable window.
- We're required to do so by law.
- We discontinue the service entirely. (We'll give reasonable notice and a way to export your content.)
On termination, your live URL goes offline. Your content remains until you ask us to delete it, subject to the subdomain hold periods described above.

Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". To the maximum extent permitted by law, LiveEPK disclaims all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the service will be uninterrupted, secure, error-free, or that any defects will be corrected. We do not warrant that your EPK will achieve any particular result with booking agents, venues, labels, or anyone else.

Limitation of liability
To the maximum extent permitted by law, LiveEPK is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenues, lost bookings, lost data, or business interruption, arising out of or related to your use of (or inability to use) the service.
Our total liability for any claim related to LiveEPK is limited to the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) one hundred U.S. dollars. Some jurisdictions don't allow limits like this; in those places, our liability is limited to the smallest amount permitted by law.

Indemnification
You agree to indemnify and hold LiveEPK harmless from any claim, demand, loss, damage, or cost (including reasonable attorney fees) brought by a third party arising out of (a) content you upload, (b) your violation of these Terms, or (c) your violation of any law or third-party right.

Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. The exclusive venue for any dispute arising out of or related to these Terms is the state or federal courts located in Williamson County, Texas, and you and we consent to the jurisdiction of those courts.
Before filing anything in court, please write to [email protected]. Most disagreements can be sorted out by talking.

Changes to these Terms
We may update these Terms over time. If a change is material, we'll update the "Last updated" date at the top and, where appropriate, notify you by email or in the dashboard before the change takes effect. Continuing to use LiveEPK after a change means you accept the updated Terms.

Miscellaneous
- Entire agreement. These Terms plus our Privacy Policy are the whole agreement between you and LiveEPK about the service.
- Severability. If a court finds part of these Terms unenforceable, the rest still applies.
- No waiver. If we don't enforce a part of these Terms, that doesn't mean we've given up the right to enforce it later.
- Assignment. You can't transfer your rights under these Terms without our written consent. We may transfer ours (for example, if LiveEPK becomes an LLC or is acquired) with reasonable notice to you.
